PRESENTATION

These conditions (hereinafter referred to as “GTC”) exclusively govern the relations between:

• on the other hand, any consumer (hereinafter referred to as the customer) acting on his own account, who makes remote purchases via the store.sarlatrugby.fr website (hereinafter referred to as the “store”).

The Sarlat Rugby store reserves the right to adapt, modify or update the GTC at any time. The GTCs in force on the day the order is placed will be applied to each order.

If a condition were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector whose companies are headquartered in France.

ARTICLE 1: OBJECT

The GTC are intended to define the rights and obligations of the parties relating to the online sale of products offered on the site by the Sarlat Rugby store.

ARTICLE 2: ORDER

For any payment by credit card, the credit card is debited upon final validation of the order. In the event of a payment incident, the order is canceled.

2.5 Order refusal

The Sarlat Rugby store reserves the right to suspend any order management and any delivery in the event of:

• Non-payment

• From an order from a customer who has not fully or partially paid a previous order or with whom a payment dispute is in progress

ARTICLE 3: DESCRIPTION AND AVAILABILITY OF PRODUCTS

Product offers are valid as long as they are visible on the site. The products are described and presented with the greatest possible accuracy. In the event of errors or omissions, the Sarlat Rugby store cannot be held liable. The photographs of the products are not contractual.

The Sarlat Rugby store undertakes to honor orders received within the limits of available stocks. In the event of unavailability of a product after placing the order, the customer will have the possibility to cancel only the part of the order relating to said product and will have the choice either:

ARTICLE 4: PRICE

Prices are quoted in euros all taxes included. They take into account the VAT applicable on the day of the order. Any change in the applicable rate may be reflected in the prices of the products. Payment of the full price must be made when ordering.

The Sarlat Rugby store reserves the right to modify its prices at any time.

With the exception of Article 5.3 paragraph 2, the prices are understood to be exclusive of the flat-rate contribution to the costs of processing the order (postage, packaging and preparation of the package) which will be invoiced to the customer in addition, and indicated before the validation of the ordered.

ARTICLE 5: DELIVERY

The Sarlat Rugby store has chosen CHRONOPOST services for its shipments. We do express delivery for the international orders, and classic delivery in France. We also propose you Colissimo to deliver in France.

5.1. Place of delivery

The Sarlat Rugby store can in no way be held responsible in the event of delay and / or non-delivery due to the address indicated by the customer.

• Metropolitan France

In the event that the parcel is returned by the delivery company to the Sarlat Rugby store, customer service will offer a possible reshipment to the customer at its expense, in the absence of a response within 30 days, the customer will be reimbursed.

• International

Sarlat Rugby is not liable for shipping deliveries that may be affected by customs. Any incurred costs upon delivery are the sole responsibility of the customer. Charges may vary depending on your location and importation tax laws.

In the event that the parcel is returned by the delivery company to the Sarlat Rugby store, customer service will offer a possible reshipment to the customer at its expense, in the absence of a response within 30 days, the customer will be reimbursed.

5.2. Delivery time

The delivery time is a maximum of 30 days from the day following the order (except in a particular situation indicated to the customer before placing the order with an estimated range of delivery time) subject to full payment of the price.

Delivery times cannot be guaranteed in the event of force majeure.

For orders including items to be personalized, a maximum additional preparation time of 4 days will be taken into account. For products in pre-order or out of stock, the delivery period starts from the date of availability of the products.

After 6 weeks without delivery, the customer will be entitled to the cancellation and reimbursement of his order.

5.3. Delivery cost

Logistics preparation and shipping costs are shown inclusive of VAT. The amount of the service varies according to the weight of the package. Any customs charges may be requested from the customer upon delivery without reimbursement.

Shipping costs will be free for purchases of € 120 including VAT on the Sarlat Rugby store site only for Metropolitan France and Europe.

In-store pickup will only be possible in the Sarlat Rugby warehouse located at 89 Avenue de Selves, in Sarlat-La-Canéda (24200) in which case shipping costs will be free.

CHRONOPOST PRICES

5.4. Delivery completed

Each delivery is deemed to have been made upon delivery of the item to the customer accompanied by an invoice detailing the price of the items as well as the delivery costs.

The Customer is expressly informed that it is his responsibility, upon delivery of the package, to check its condition, content and compliance with the order. In the event of non-compliance, the customer must expressly state this on the delivery slip.

ARTICLE 6: RIGHT OF WITHDRAWAL

In accordance with the provisions of Article L. 221-18 et seq. Of the Consumer Code, the customer has a withdrawal period of 14 clear days from the date of delivery of his order, to return any item not to him. not suitable and request the exchange or refund, without having to justify reasons or pay penalties (excluding return costs).

Any product damaged or whose original packaging has been damaged will not be refunded or exchanged. Only products in perfect condition for resale and in their original packaging may be.

From the decision to withdraw, the customer has a period of 14 clear days to send or return the products in perfect condition in their original packaging by registered Colissimo / Chronopost to the following address: Sarlat Rugby, attention of the e-store service, 89 Avenue de Selves, in Sarlat-La-Canéda (24200).

In the case of a gift, the right of withdrawal remains for the exclusive benefit of the customer and not the recipient of the gift.

As an exception, and in accordance with the provisions of article L 221-28 3 ° of the Consumer Code, the customer is informed that the right of withdrawal is not applicable to sales of personalized items, eg flocking.

ARTICLE 7: PRODUCT COMPLIANCE

If at the time of delivery the original packaging is damaged, torn, open, the customer must check the condition of the items and refuse the package if they are damaged by indicating on the delivery note his reserves in a handwritten manner with his signature. He will then confirm these reservations to the carrier by registered letter within two working days of receipt of the package, sending a copy of the letter to the Sarlat Rugby store.

In the event of non-compliance with these rules, the complaint will not be taken into account and will release the Sarlat Rugby store from all liability.

The Sarlat Rugby store undertakes to exchange, make a credit or a refund on defective, damaged or damaged or non-compliant products.

The credit note is valid for 3 months from the date of issue.

ARTICLE 8: RETURN

In the event of withdrawal or non-compliance, the products must be returned by the customer, within 14 clear days of receipt of the order in their original packaging, neither damaged nor deteriorated, complete, clean and unworn, accompanied by the original invoice and the reasons for the non-compliance, if applicable.

In the event of non-compliance with these conditions, the items will not be refunded or exchanged.

ARTICLE 9: REIMBURSEMENT 

In the event of withdrawal, non-compliance or cancellation of the order for unavailability, the Sarlat Rugby store undertakes to reimburse the customer within fourteen working days by crediting the customer’s bank account corresponding to the card. bank used for payment or by bank transfer.

In the event of a new order:

• If the new order is for a higher amount, the customer must attach payment of the remainder to the exchange request.

For health reasons, products such as socks, caps, masks, bracelets are not refundable but exchangeable in the event of defective products.

Customizable products are not returnable or refundable and exchangeable, unless one or more damages are noted.

Returned products will be subject to verification by the Sarlat Rugby Team, once the reason for the return has been confirmed, the refund will be initiated. Once the product arrives at our premises, we will verify it as soon as possible.

ARTICLE 10: RESPONSIBILITIES AND GUARANTEES

10.1. In accordance with the regulations in force, the Sarlat Rugby store undertakes to comply with its legal obligations relating to the guarantees attached to the items sold on the site and which appear in articles L. 217-4 to L. 217-13 of the French Code of Consumption and articles 1641, 1648 and 2232 of the Civil Code.

10.1.1. Legal guarantee of conformity

When the customer acts as a legal guarantee of conformity, he has a period of two years from the delivery of the items to act. He can choose (subject to the cost conditions provided for in Article L211-9 of the Consumer Code), between repairing and replacing items. The customer may also request reimbursement of the items in the Order.

He is exempted from providing proof of the existence of the lack of conformity of the articles during the twenty-four months following the delivery of the articles.

The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.

10.1.2. Guarantee of hidden defects

The customer can implement the guarantee against hidden defects of the items sold within the meaning of article 1641 of the civil code. If applicable, he has an option between the resolution of the sale or a reduction in the sale price (article 1644 of the civil code).

The guarantees do not apply to normal wear and tear of certain parts or articles; in the event of professional or collective use or for damage caused by causes external to the articles.

10.2. For all stages of access to the site, consultation, filling out forms, placing an order, delivering items or any other service, the Sarlat Rugby store has only an obligation of means.

10.3. The Sarlat Rugby store rejects all responsibility, from the time the order is handed over to the delivery company, for any event affecting the delivery, which is attributable either to the customer or to the fact, unforeseeable and insurmountable, of a third party, or a case of force majeure.
